Taylor Morrison is committed to protecting the personal information of the homebuying public, REALTORS®, other real estate brokers, trade partners and other users of the Internet regarding our communities, homes, financial services and other related products and services. We want you to understand how we use your personal information when you sign up to receive information by enrolling or otherwise agreeing to receive text messages from Taylor Morrison. For purposes of this SMS Privacy Notice, “Taylor Morrison”, “we”, “us” or “our” shall mean Taylor Morrison, Inc. and its affiliates and subsidiaries, as described in our Privacy Policy.
When you enroll or otherwise agree to receive text messages on our website, Taylor Morrison collects your name, email address, and phone number. Your information will be used for us to communicate with you about your sales appointment confirmation and reminders, as well as direct marketing and lead development. Your information may be disclosed to Taylor Morrison’s program partners, message content providers, phone companies, and vendors (e.g., customer relationship management services) who assist us in the delivery of mobile messages only and for no other purpose not otherwise disclosed in our Privacy Policy.
Unless permitted, required or in accordance with the law, we do not sell, rent, loan, trade, lease or otherwise transfer for profit any Opt-In consent. PLEASE READ THE FOLLOWING SMS TERMS AND CONDITIONS (“SMS Terms”) CAREFULLY BEFORE PROCEEDING. By enrolling or otherwise agreeing to receive text messages from Taylor Morrison, you agree to these SMS Terms, as well as Taylor Morrison’s Terms of Use and Privacy Policy, which are incorporated herein by reference and can be viewed at the links provided here, or at https://www.taylormorrison.com. For purposes of these SMS Terms, “Taylor Morrison”, “we” or “us” shall mean Taylor Morrison, Inc. and its affiliates and subsidiaries (as described in our Terms of Use).
Opting into Text Messages:
Opt In by Web at New Homes for Sale from America's Most Trusted Home Builder. By entering your mobile number, you consent to receive important updates and marketing messages from Taylor Morrison regarding events, upcoming appointments, promotional offers, and general information about our homes and services. Message frequency varies. Message & data rates may apply. By opting in, you are authorizing Taylor Morrison to deliver SMS messages using automatic telephone dialing system and understand that you are not required to opt in as a condition of purchasing any property, goods, or services. To Opt Out, Text STOP to 63333 to stop receiving TM Home Alerts messages from Taylor Morrison (you will receive a confirmation text). E-Sign Disclosure:
By agreeing to receive text messages, you also consent to the use of an electronic record to document your agreement. You may withdraw your consent to the use of the electronic record by Texting “STOP” to 63333or for additional information, text HELP to 63333 or email contactus@taylormorrison.com. To view and retain a copy of this disclosure or any information regarding your enrollment in this program, you will need (i) a device (such as a computer or mobile phone) with a web browser and Internet access and (ii) either a printer or storage space on such device. ELIGIBILITY:
By opting into Taylor Morrison’s text messaging program or by otherwise providing your cell phone number to Taylor Morrison, you warrant that you are 18 years of age or older. You further warrant that you are the current subscriber or authorized user of the phone number you have provided. You agree that you will not initiate messages to the mobile phone of any other person or entity without authorization. Failure to do so constitutes a material breach of these SMS Terms and Taylor Morrison’s Terms of Use. Mobile carriers are not liable for delayed or undelivered messages.
Participating Carriers:
Participating carriers may be changed at company’s sole discretion without prior notice. The content is not compatible with all cell phone models. We will not be liable for any delays in the receipt of any SMS messages or changes to the participating carriers as delivery is subject to effective transmission from your carrier with active participation at that time.
Opting Out of Our Text Messages:
While messages and notifications are intended to enhance your use of the services and our Sites, you may Text STOP to 63333 to opt-out of all SMS messages . After Opting Out, we will send you confirmation of your opt-out via text message. If you have revoked consent and want to Re-enroll in our text message program, you can resume your enrollment by opting in again by web at New Homes for Sale from America's Most Trusted Home Builder.
Our Liability:
Depending on your current carrier plan, you may incur charges for these messages and notifications and agree to not hold Taylor Morrison liable for any charges incurred. You acknowledge that any terms between you and any third-party provider create no obligation or responsibility on the part of Taylor Morrison, and that Taylor Morrison is not responsible for any failure of warranty by any such third party. Taylor Morrison cannot control certain factors relating to message delivery. You acknowledge that, depending on your mobile carrier’s service, it may not be possible to transmit a text message to you successfully. We have no liability for transmission delays or message failures.
Cost:
Message and data rates may apply for any messages sent to you from Taylor Morrison, and messages you send to us. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
Changes to the SMS Terms:
These SMS Terms may be updated by Taylor Morrison at any time without prior notice. By continuing to be enrolled in any Taylor Morrison promotional texting program, or by providing your cell phone number for transactional, operational or informational text messages, you agree to any changes.
LAW AND JURISDICTION:
These SMS Terms shall be governed by, construed and enforced in accordance with, and subject to, the laws of the State of Arizona, without resort to its choice of law provisions and case law, except to the extent they are superseded or preempted by the laws of the United States or other jurisdictions. If any provision of these SMS Terms is determined to be invalid, unlawful, void or otherwise not enforceable, you agree that the remaining provisions of these SMS Terms will remain in full force and effect. By enrolling or otherwise agreeing to receive text messages from Taylor Morrison, you submit to the exclusive jurisdiction of the state courts in Maricopa County, Arizona, or the United States Federal District Court, for the District of Arizona (Phoenix Division), to resolve disputes of any kind arising out of or relating in any way to any Taylor Morrison text message service. Any claim you have with respect to these SMS Terms or a Taylor Morrison text message service must be brought within two years and one day after the claim arises.
IF THERE IS A CONFLICT BETWEEN THE LAW IN YOUR USUAL PLACE OF RESIDENCE AND THESE SMS TERMS, YOUR RIGHTS UNDER APPLICABLE LOCAL LAW MAY PREVAIL.
